INTRODUCTION:- John & Melody Heath T/A "JoMell Group”, “JoMel Group”, "The JoMel Group", “we”, “us”, “our”, is committed to providing a high standard of service to all clients who respond to any of our communications, adverts, websites or promotions etc. These terms & conditions have therefore been prepared to inform all parties of the principles governing the use of our services.
- By accessing and using any of the services offered by us, all parties agree to be bound by the terms and conditions set out herein. Please DO NOT use our services if you do not agree to be bound by these terms & conditions. We may at any time modify these terms & conditions and your continued use of our services will be subject to the terms and conditions in force at the time of your use, therefore please review from time to time. We reserve the right at any time to change or discontinue, without notice, any aspect, feature or service offered by way of any of our communications, adverts, websites or promotions.
- No opinions, information, data or content contained in any of our communications, adverts, websites or promotions shall be construed as advice and same are offered for information purposes only.
Include but are not limited to the following: Web design, Promotions, Adverts, Graphic Design, Email Campaigns, Social Media, Improving Online Visibility, Marketing Consulting, Corporate Image & Logo Design.

2) Improving Visibility & Ranking: We improve the visibility of your company via your, corporate identity, logo design, websites, social media, consulting, adverts or marketing campaigns.
You Agree To:
- You agree to abide by these terms and conditions in respect of any marketing, consulting or products or services prepared for which you need to pay as well as the fees that may be charged and that you are responsible for all charges, fees, duties and taxes arising out of the use of our services (as well as for any use of your account, your name, or your company, organization or business name by any of your staff members or others, including any person under the age of eighteen years)
- Once you have indicated in writing that you require our services, you are legally bound to these terms and conditions and agree to our 2% admin fee charged on services requested, whether used or not. If you decide to no longer make use of our services after requesting to make use of our services, you shall still be held liable for the admin fee of 2%, minimum R200, maximum 2% of services requested.
- Once you have indicated in writing that you accept our services, using phrases like “ready to pay”, “accept quote”, “invoice us” or any other phrases or words indicating the same, you are legally bound to pay the invoiced price of the services required. If agreed payment has not yet been made and you decide to no longer use our services, you are still legally bound to pay us 5% of the total for services rendered, and or the amount already spent to provide your requested service, Minimum R200, maximum 5% + costs.
- Work on agreed marketing, consulting or services will only commence once proof of 50% has been received and or confirmed to show in our bank account.
- Once work has been completed and checked by the client, there will be one opportunity to make changes under the existing invoice, thereafter, adjustments to the services requested will be charged to a new invoice and work will only commence once proof of 50% payment has been received.
Breach of Contract:
- Non-payment will result in breach of contract resulting in the marketing service or consultation being suspended immediately with a admin fee of R250 being added to any outstanding amount. Only once the outstanding amount plus the admin fee are paid will the services be resumed.
- Making contact with any of our suppliers before completion date will result in a breach of contract.
- providers Once you have requested our services you furthermore agree to not contact any service provider that we recommend to you until payment has been received, after which all contact details etc will be sent to you by us.
- We hereby agree to provide the services you requested as only as agreed upon in writing.
- Where we cannot provide the services requested we will to the best of our ability find the appropriate supplier to meet your requirements.
- We agree to arrange with the
supplier all your requests and cannot be held liable where such requested
services are not delivered or fulfilled on the agreed dates. All requests or
services should be discussed with the service provider once we have sent you a
booking form with their contact details.
- Proof of 100% payment received within 24 hours of this communication being sent by us confirms this booking, unless an alternative date and time are set. We will then confirm your booking or service with you and the service provider.
- Any deposits less than 100% WILL NOT confirm a booking or service. Where full payment (100%) has not been received by due date, such booking or service will be cancelled , possibly without a refund, depending on the service provider. You will however still be liable for our 5% admin fee of the total amount invoiced minimum R100 and maximum 5%.
- Once 100% payment has been received the service provider will be paid.
- Strictly NO REFUNDS less than 21 days before arrival. Only cancellations or changes received before 21 days will be considered for refunds.
- NO REFUNDS will be given for services booked but not used, or for late arrivals or early departures.
- Please note that when a refund
has been agreed upon, a commission of 15% of the total amount, minimum R100,
plus possible 3rd party fees and extra admin costs might be deducted
from any cancellations or possible refunds.
- Please also note that each
establishment or service provider have their own cancellation policies that
might vary from ours, and therefore could also affect any refunds.
- In the case where a double booking might occur or where a supplier cancels a service due to booking another customer or any unforeseen reason, 85% of the payment received will be paid back or used to secure the next best accommodation or service.
- By paying for or requesting any of our services, accommodation, activities, transport, venues or catering, you are thereby agreeing that you are making use of our services and are aware of all our terms, conditions disclaimers and indemnities and service fees.
- You also agree that you accept responsibility for your own safety as well as your group (family, friends, colleagues and/or clients and/or referred guests) and hereby agree to not hold us, our staff, suppliers, and anyone in anyway related to our activities responsible for any loss, damage, injury or death while making use of any of our services, information, products or referrals.
- You hereby declare that our marketing etc. will in no way promote or assist in any illegal, profane or discriminatory activities being performed by you, your business or your clients or visitors to your website or promotional products.
- Any damages to our property, business or personal or our property or misuse of facilities, lost keys, lost remotes, leaving stoves or heaters on while off the premises will be for your account. Accommodation and other services are sold as is, and as advertised by the various establishments. We do not own or manage any accommodations advertised except Grateful Guest House in Bloemfontein, and therefore can not be held responsible for what the booked establishment or service provider does or does not offer you during your stay and can therefore not be held responsible in any way for what happens on their premises or with any services they might or might not provide. All queries should be taken up with the relevant reception desks of the establishment or service you booked.
- Delay or failure to comply with or breach of any of these terms and conditions if occasioned by or resulting from an act of God or public enemy, fire, explosion, earthquake, perils of the sea, flood, storm or other adverse weather conditions, war declared or undeclared, civil war, revolution, civil commotion or other civil strife, riots, strikes, blockade, embargo, sanctions, epidemics, act of any Government or other authority, compliance with Government orders, demands or regulations, or any circumstances of like or different nature beyond the reasonable control of the party so failing, will not be deemed to be a breach of these terms and conditions nor will it subject either party to any liability to the other.
- In the event that either party is prevented from carrying out its obligations in terms hereof by reason of force majeure on or during the agreed dates of this agreement, invoice or quote, the parties will consult with each other regarding the future implementation of these terms and conditions. If no mutually acceptable arrangement is arrived at within a period of 7 (seven) days thereafter, JoMel Group shall be entitled to terminate all of its rights and obligations in terms of or arising from these terms and conditions and/or any service forthwith on written notice.
Definition:
- Marketing includes, but is not limited to: Webdesign, Promotions, Email Campaigns, Social Media, Improving Online Visibility, Corporate Image & Logo Design.

Credit card booking through a website: R200 per hour
- Proof of 50% payment needs to be received before any work can begin on your campaign.
- Proof of 50% payment needs to be received before marketing campaign is launched.
- Website and other marketing campaigns carry a minimum monthly fee of R100.
- No refunds once work has commenced.
- We reserve the right to refer a portion or your complete campaign to a 3rd party service provider, in order to launch your campaign succesfully.
- We reserve the right to refuse publishing content which we deem illegal, disrespectful or misrepresenting.
- Once a website or marketing campaign and content has been approved by you and published, full responsibility of content and all effects that such content might have on your clients or the general public will be solely for your account, whether caused by server failure, viral infiltration or hackers.
